Wilkinson (1991) suggests that the problems of polarity decisions and homoplasy in a cladistic analysis may be solved if cladists simply accept plesiomorphy as a reliable indicator of monophyly. Here we argue that: (1) Wilkinson's argument is based on misapprehension of synapomorphy and the problem of homoplasy; (2) His proposed methodology fails to consider the full ramifications of rooting, polarity, and parsimony; and (3) His method does not solve the problems he raises. We demonstrate the limitations of this methodology by (...) using Wilkinson's practical example. We find no justification for the assertion that plesiomorphy may reliably delimit monophyly and recommend against Wilkinson's suggested methodological revisions. (shrink)

DBS Think Tank IX was held on August 25–27, 2021 in Orlando FL with US based participants largely in person and overseas participants joining by video conferencing technology. The DBS Think Tank was founded in 2012 and provides an open platform where clinicians, engineers and researchers can freely discuss current and emerging deep brain stimulation technologies as well as the logistical and ethical issues facing the field. The consensus among the DBS Think Tank IX speakers was that DBS expanded in (...) its scope and has been applied to multiple brain disorders in an effort to modulate neural circuitry. After collectively sharing our experiences, it was estimated that globally more than 230,000 DBS devices have been implanted for neurological and neuropsychiatric disorders. As such, this year’s meeting was focused on advances in the following areas: neuromodulation in Europe, Asia and Australia; cutting-edge technologies, neuroethics, interventional psychiatry, adaptive DBS, neuromodulation for pain, network neuromodulation for epilepsy and neuromodulation for traumatic brain injury. It is not, however, either strictly a handbook or a complete exploration of either art education policy or research. This in no way diminishes its potential value as a source for policy issues and research that are of significant concern to the field.The publication presents 36 individual or joint authored chapters on (1) historical currents in art education, (2) policy perspectives impacting the teaching of art, (3) learning in the visual arts, (4) teaching and teacher education, (5) forms of assessment in art education, and (6) emerging visions of the field. Each of the six sections begins with a short introductory statement by the researcher responsible for reviewing the essays in that session. These section editors include F. Graeme-Chalmers, Ralph Smith, Anna Kindler, Enid Zimmerman, Elisabeth Soep, and Arthur Efland. Forty-one authors contributed to the book's contents, all of which have nationally recognized expertise in handling the topic discussed.Editors Elliot Eisner and Michael Day view the book as an effort to bring together research and theory, policy, and concepts that guide and give shape to what people in art education try to accomplish—which is, of course, a rather ambitious goal. Even the editors admit the Handbook meets some but not all of these competing orientations. They also claim that the Handbook serves as an assertion that art education is a scholarly field, perhaps even to a fault through mostly ignoring qualitative issues regarding goals, expressive art form, and aesthetics. Also, the editors admit that the Handbook will be a disappointment, which is true, especially with respect to its emphasis on rationales rather than policy problems, on assessment appreciation rather than policy and research, on assessment in art education history as a record of events rather than as policy windows, and on emerging visions as older forms of social and political discourse rather than policy issues, implementation, and evaluation.Nevertheless, the Handbook addresses a number of important policy issues, providing well-developed and valuable views of the field by a variety of important authors and, in some cases, with some rarely seen insights into the nature of the field. I will only review the most salient ideas of the chapter authors in each of the six sections and then comment on what I believe are promising, and sometimes somewhat troubling, directions pointed out in the chapters, including what promises have not been fulfilled. Overall, he references nearly 300 publications. Stankiewicz, Amburgy, and Bolin then address specific movements in nineteenth-century art education and art, including a brief history of the social function of art, drawing instruction in schools, industrial drawing, manual training, the arts and crafts movement picture study, and progressive education with over 120 references. White, who follows, provides a similar review of major forces, focusing mainly on art education influences in the twentieth century, addressing the contributions of various art educators, arts organizational leaders, artists, government initiatives, and the critical and divergent influences of key post–WW II art education writers. Corpus linguistics is becoming a respected method of statutory and constitutional interpretation in the United States over the past decade, yet it has also generated a backlash from a group of scholars that engage in empirical work. This essay attempts to demonstrate both the contributions and the risks of using linguistic corpora as a primary tool in legal interpretation. Its legitimacy stems from the fact that courts routinely state that statutory terms, when not defined as a matter of law, are (...) to be given their ordinary meaning. Judges have responded to this challenge, with the assistance of the linguistics community, by using corpora to determine which meanings are ordinary. However, legal analysts have not determined exactly what makes one meaning ordinary and another not ordinary. This gap has led to a level of disagreement in the field. Moreover, while linguists who engage in corpus linguistic analysis typically emphasize the importance of context, the legal application is peculiarly context-free, in keeping with legal philosophies that eschew reliance on reference to a law’s purpose and the intent of the legislature that enacted it. This move adds a political dimension to corpus analysis as a means of legal interpretation. Yet, the article concludes that by relying on a blend of general and specialized corpora, the legal system can substantially reduce the problem of contextualization, as some linguists and practitioners have already recognized. I propose that primary conscious awareness arises from synchronized activity in dendrites of neurons in dorsal thalamic nuclei, mediated particularly by inhibitory interactions with thalamic reticular neurons. In support, I offer four evidential pillars: consciousness is restricted to the results of cortical computations; thalamus is the common locus of action of brain injury in vegetative state and of general anesthetics; the anatomy and physiology of the thalamus imply a central role in consciousness; neural synchronization is a neural correlate of consciousness.

Shepard proposes that the human mind relies on screw displacement because of its adaptive simplicity and uniqueness. Wikipedia has challenged traditional notions about the roles of experts in the Internet Age. Section 1 sets up a paradox. Wikipedia is a striking popular success, and yet its success can be attributed to the fact that it is wide open and bottom-up. How can such a successful knowledge project disdain expertise? Section 2 discusses the thesis that if Wikipedia could be shown by an excellent survey of experts to be fantastically reliable, then experts would not need to be granted (...) positions of special authority. But, among other problems, this thesis is self-stultifying. Section 3 explores a couple ways in which egalitarian online communities might challenge the occupational roles or the epistemic leadership roles of experts. There is little support for the notion that the distinctive occupations that require expertise are being undermined. It is also implausible that Wikipedia and its like might take over the epistemic leadership roles of experts. Section 4 argues that a main reason that Wikipedia’s articles are as good as they are is that they are edited by knowledgeable people to whom deference is paid, although voluntarily. But some Wikipedia articles suffer because so many aggressive people drive off people more knowledgeable than they are; so there is no reason to think that Wikipedia’s articles will continually improve. Moreover, Wikipedia’s commitment to anonymity further drives off good contributors. Generally, some decisionmaking role for experts is not just consistent with online knowledge communities being open and bottom-up, it is recommended as well. (shrink)

The essay is an attempt to examine aspects of legal interpretation from an external, sociological point of view. “Interpretation”, in its normal juristic sense, is primarily a process in which decision‐makers with secondary legitimacy link their decisions to authority of primary legitimacy. The type of legitimacy which is dominant within the legal system greatly influences the style of interpretation ‐ in “closed” systems, where the stock of premises is fixed, “legalism” will abound. Legal interpretation is not concerned with what a (...) text really means, in any literal sense; and standards for judging legal interpretation are different from the standards of judging other forms of communication, for example, literature. The title of our session today is “Virtue Ethics from a Global Perspective.” In my remarks, I would like to sketch out an account of what a global perspective on virtue ethics would look like. Here’s how I’ll proceed. First, I would like to explore some of the reasons why we need a global perspective on virtue ethics. This leads naturally to the second issue, which is a clarification of what we mean by a global perspective on virtue ethics. I (...) shall suggest a three part framework—consisting of the object of the virtue, the virtue itself, and the actions through which that virtue is expressed—for a global perspective on virtue ethics. This framework is a pluralistic one, striking a middle ground between absolutism and relativism. Along the way, especially in part two, I will look at several specific virtues, especially respect and courage, to see how this tripartite framework can be applied. The final result, I hope, will be an outline of what a global perspective on virtue ethics would look like. (shrink)

Rarely has a philosopher demanded such a purity of moral motives. Even when he discusses those “many spirits of so sympathetic a temper that, without any further motive of vanity or self-interest, they find an inner pleasure in spreading happiness around them and can take delight in the contentment of others as their own work,” Kant maintains that, “in such a case an action of this kind, however right and however amiable it may be, still has no genuinely moral worth.” (...) Because the action is done from inclination rather than duty, it cannot qualify as a morally good action in Kant’s eyes. Indeed, this seems to suggest that from a moral point of view the person who is naturally unsympathetic to others almost has an advantage, at least in terms of the opportunity for moral action, over those who are naturally inclined to altruistic acts. Kant hardly seems to shrink from such a conclusion. His own words best convey his position here. (shrink)

In recent years, a particular doctrine about forms of life has come to be associated with Wittgenstein's name by followers and critics of his philosophy alike. It is not a doctrine which Wittgenstein espoused or even, given his understanding of philosophy, one which he could have accepted; nor is it worthy of acceptance on its own merits. I shall here outline the standard interpretation of Wittgenstein's remarks on forms of life, consider the textual basis for such a reading of Wittgenstein, (...) present a more consistent reading of the texts, place the problem of forms of life within a wider philosophical context, and show the ways in which it is indeed possible to say that a form of life is wrong. In the process, I shall note some important similarities between Wittgenstein's actual position, Quine's analysis of scientific knowledge, and Hans-Georg Gadamer's claims about the fusion of horizons. Search engines play an increasingly pivotal role in the distribution and eventual construction of knowledge, yet they are largely unnoticed, their procedures are opaque, and they are almost completely devoid of independent oversight. In this paper the author examines three areas in which we encounter difficult and persistent ethical issues in search engine technology: The problem of algorithm and the lack of transparency of the search process, the problem of privacy with regards of the possibility to monitor search histories, and (...) the problem of local censorship. The given findings lead to the conclusion that the development of structures of accountability for search engines is an important task for the near future. (shrink)

During development, large numbers of cells die by a process known as programmed cell death. This loss of cells plays a number of important roles, including the sculpting of the body form and the removal of vestigial tissues. Data obtained from a variety of organisms has suggested that a cell's ‘decision’ to die is a differentiative event, requiring the activation of specific sets of genes. Several putative ‘cell death’ genes have recently been cloned, and one has been identified as the (...) product of the polyubiquitin gene. Accumulation of ubiquitin has been observed not only during programmed cell death, but also in several neurodegenerative disorders, including Alzheimer's Disease. (shrink)
